Products Liability and Defective Products
Defective product claims involve injuries caused by products with design and/or manufacturing defects. For example, a lawn mower may contain a design defect because it doesn't have adequate guards, or it may contain a manufacturing defect because a guard was made improperly with inferior materials that cause the guard to fail if hit with debris. A defective product can be anything from an automobile to a food product containing a foreign substance.
What to do if you are injured by a defective product:
- DO NOT throw out the product. You MUST save the product so it can be properly inspected.
- DO NOT change the product in any way. You MUST keep the product in the same condition it was in at the time of the injury.
- Get the names, addresses and phone numbers of all witnesses.
- Preserve all available evidence by taking photos, if possible, of the scene, the product and any visible injury you have.
- Get immediate medical treatment.
- Seek the advice an attorney.
