Florida Personal Injury Lawyers: Truck Accidents
The vast majority of products transported across the United States are moved by trucks. Because of their size, increased stopping distances and decreased maneuverability, trucks pose increased risks to motorists. Unfortunately, trucking accidents often result in severe injuries or death. The government recognizes these risks and has passed many regulations governing the operation of trucks. For example, there are limits on the amounts of hours truck drivers can drive in a 24 hour period and limits on loads.
What to do if you are in a truck accident:
- Call the police so a formal report can be made.
- Get all available information from the drivers involved and all witnesses. This includes names, addresses and phone numbers, license plate numbers, the year, make and model of the vehicles involved, and insurance information. Don't assume the police officer writing the report will identify all the witnesses.
- Preserve all available evidence by taking photos, if possible, of the scene, the vehicles, and any visible injury you have.
- Do not speak with anyone other than the police officer investigating the accident about how the accident happened. Your statements to the police officer are not admissible in Court. However, your statements to others at the scene are.
- Get immediate medical treatment.
- Seek the advice an attorney.
Experienced team of professionals
DeLoach & Hofstra, P.A. has an experienced team of professionals ready to investigate and aggressively pursue your claim. We employ all the latest technologies, from aerial photography to accident reconstruction and analysis, to aggressively pursue your case. From case investigation to trial, we have the resources and experience necessary to get you the compensation you deserve.
Federal Laws That May Apply in Your Case
If you have been injured in a truck crash involving a semi, 18-wheeler or other commercial truck, there are federal laws that may play a role in your case. Commercial truck drivers are subject to strict government regulations regarding the number of hours they may drive and the load they may haul.
If you have been injured by a commercial truck driver who violated federal law, you may have a basis to receive financial recovery through a personal injury lawsuit. Even if federal laws have not been violated, our attorneys may be able to file a lawsuit based on negligence. Speeding, drunk driving, inattentive driving, failure to yield, driver fatigue, failure to obey a stop sign and other driving errors may form the basis of a negligence based claim.
